These Terms of Service ("Terms") govern your access to and use of the QAlimucho platform, including the web application, browser extension ("QAlimucho Assistant"), and WordPress plugin (collectively, the "Products"), operated by Springbeats SARL, a company registered in France with its registered office at 12 rue Louis Renault, 31130 Balma ("QAlimucho", "we", "us").
By creating an account or using our Products, you agree to be bound by these Terms.

You must be at least 16 years old to use QAlimucho. If you are under 18, you must have the consent of a parent or legal guardian.
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account or create multiple accounts to circumvent limitations or restrictions.
Subscription fees are displayed on our pricing page and are inclusive of applicable taxes. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable, except as required by applicable law.
We will notify you by email at least 30 days before any price increase takes effect. If you do not agree with the new pricing, you may cancel your subscription before the change takes effect.
QAlimucho is designed to help you test and monitor websites and web applications. When using our Products, you must comply with the following rules:
You may only use QAlimucho to run automated tests on websites and applications that you own or operate, or for which you have obtained explicit written authorization from the owner to perform automated testing. Unauthorized testing of third-party websites is strictly prohibited.
You must not use QAlimucho to:
Your subscription tier determines the number of test runs, scheduled checks, and recorded flows you may use. Exceeding these limits may result in throttling or temporary suspension of your access.
You retain ownership of all recordings, test configurations, schedules, and results ("Your Data") that you create using QAlimucho. We do not claim any intellectual property rights over Your Data.
We use Your Data solely to provide and operate the Products. We do not sell, share, or use Your Data for advertising purposes. We may access Your Data when necessary to provide technical support at your request or to enforce these Terms.
You are solely responsible for the credentials and sensitive information used in your test scenarios. We recommend using dedicated test accounts and credentials rather than production credentials. QAlimucho is not liable for any unauthorized use of credentials stored in your test configurations.
You may export Your Data at any time from your account. We recommend exporting your data before cancelling your subscription or deleting your account.
The QAlimucho Assistant browser extension records user interactions only when explicitly activated by you. It does not run in the background, does not collect browsing data outside of recording sessions, and does not modify web pages outside of a recording session. You are responsible for ensuring you have the right to record interactions on any website you test.
The QAlimucho WordPress plugin enables a simulated payment gateway for WooCommerce during automated test runs. It is designed to prevent test orders from being processed by real payment providers. You must only install the plugin on stores you own or are authorized to manage, and you are responsible for its correct configuration.
QAlimucho is provided on an "as is" basis. While we strive to provide reliable and accurate testing tools, we do not guarantee that:
QAlimucho is a testing and monitoring tool, not a substitute for professional quality assurance or security auditing services.
To the fullest extent permitted by applicable law, QAlimucho shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities arising from your use of the Products.
In particular, QAlimucho shall not be liable for any damages or consequences resulting from:
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
We may suspend or terminate your account if you breach these Terms, including but not limited to running unauthorized tests on third-party websites, non-payment of fees, or engaging in any activity that threatens the security or integrity of our platform or other users.
You may terminate your account at any time from your account settings. Upon termination, your access to the Products will cease and Your Data will be permanently deleted after a 30-day grace period during which you may export it.
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance by email. If you do not agree with the updated Terms, you may terminate your account before they take effect. Continued use of the Products after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of France. Any dispute arising from these Terms shall be submitted to the competent courts of Toulouse.
If you are a consumer in the European Economic Area, you retain the benefit of any mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.
